- "Customer," "you," "your" refers to the individual or entity using our Services.
- "Shipment" refers to goods or packages tendered to us for transportation.
- "Services" refers to all shipping, logistics, and related services we provide.
- "Website" refers to cargoship.com and our mobile applications.
- "Consignor" refers to the party shipping goods.
- "Consignee" refers to the party receiving goods.
3. Service Agreement
3.1 Service Provision
We provide domestic and international shipping, freight forwarding, and logistics services to individuals and businesses. Service availability may vary by location and is subject to applicable laws and regulations.
3.2 Service Limitations
Service may be limited or unavailable in certain regions, including embargoed or sanctioned countries. We reserve the right to refuse or cancel shipments that violate our policies or applicable law.
3.3 Contract Formation
A shipping contract is formed when we accept your shipment and provide a tracking number or confirmation. All shipments are subject to these Terms and our published rates.
4. Customer Obligations and Responsibilities
4.1 Accurate Information
You are responsible for providing complete, accurate, and current information for all shipments, including:
- Consignor and consignee contact information and addresses
- Accurate description and value of shipped goods
- Proper classification of dangerous or restricted items
- Required shipping documentation and permits
4.2 Packaging Requirements
You must ensure all shipments are properly packaged, labeled, and prepared for transport in accordance with our guidelines and carrier requirements.
4.3 Legal Compliance
You must comply with all applicable laws, regulations, and shipping restrictions for both origin and destination countries.
4.4 Payment Obligations
You agree to pay all charges for services rendered, including shipping fees, surcharges, and any applicable taxes or duties.
5. Pricing and Payment Terms
5.1 Service Rates
Rates are based on shipment weight, dimensions, destination, service level, and transport method. Current rates are published on our website and may change without notice.
5.2 Additional Charges
- Fuel surcharges and adjustments
- Accessorial service charges
- Handling fees for special requirements
- Detention and storage charges
- Customs and regulatory fees
- Insurance and declared value charges
5.3 Payment Terms
Payment is due at the time of booking unless otherwise agreed. We accept major credit cards, ACH transfers, and business checks. Late payments may incur interest and collection fees.
5.4 Disputes and Adjustments
Billing disputes must be submitted in writing within 30 days of invoice date. Adjustments are made at our sole discretion.
6. Liability and Insurance
6.1 Limitation of Liability
Our liability for loss or damage is limited to $100 per shipment unless additional insurance is purchased. We are not liable for indirect, incidental, or consequential damages.
6.2 Cargo Insurance
Additional insurance is available for declared values up to $10,000 per shipment. Insurance must be requested at the time of booking.
6.3 Claims Process
Claims for loss or damage must be filed within 14 days of delivery. Supporting documentation is required. Claims are processed within 30 days.
6.4 Exclusions
We are not liable for loss or damage caused by improper packaging, prohibited items, force majeure events, or delays outside our control.
8. Delivery Terms and Conditions
8.1 Delivery Schedules
Delivery times are estimates and not guaranteed. Delays may occur due to weather, customs, or other factors beyond our control.
8.2 Delivery Attempts
We make up to two delivery attempts. If unsuccessful, the shipment may be held for pickup or returned to sender at your expense.
8.3 Proof of Delivery
Signature or electronic confirmation may be required for delivery. Proof of delivery is available upon request.
8.4 Delivery Modifications
Changes to delivery address or schedule must be requested before dispatch and may incur additional fees.
9. Website and Technology Use
9.1 Permitted Use
You may use our website and mobile app for lawful purposes only. Unauthorized use, including hacking or scraping, is prohibited.
9.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
9.3 Intellectual Property
All content, trademarks, and technology on our website are the property of CargoShip, Inc. and may not be used without permission.
10. Force Majeure and Service Disruptions
We are not liable for delays or failures caused by events beyond our control, including weather, natural disasters, labor strikes, or government actions.
10.1 Covered Events
Covered events include but are not limited to acts of God, war, terrorism, pandemics, and regulatory changes.
10.2 Notification and Resolution
We will notify customers of major service disruptions and work to restore service as soon as reasonably possible.
11. Dispute Resolution
11.1 Informal Resolution
We encourage you to contact our customer service team to resolve any disputes or concerns before pursuing formal action.
11.2 Formal Dispute Process
Disputes not resolved informally may be submitted to binding arbitration in Miami, Florida, under the rules of the American Arbitration Association.
11.3 Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
12. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, describes how we collect, use, and protect your personal information.
13. Modifications to Terms

14. Termination
14.1 Termination by Customer
You may terminate your account or stop using our Services at any time. Outstanding obligations remain enforceable.
14.2 Termination by Company
We may suspend or terminate your access to Services for violation of these Terms or applicable law, with or without notice.

15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and CargoShip, Inc.
